SETTLEMENT TOTALS $2 MILLION-PLUS
BUTLER -- On Wednesday, April 26, 2000, a settlement in excess of a million dollars was made by Willow Trace Nursing Home of a civil suit for the death of Bonnie Emmons after a jury was seated for the trial.
The family entered the suit against Willow Trace Nursing home for the death of Mrs. Emmons which they contended happened on July 11, 1997, as a result of institutional neglect in the failure of Willow Trace to promptly secure adequate medical treatment for an impaction.
It was contended that the impaction ultimately caused Mrs. Emmons to choke to death on her own stomach contents. It was also contended that the nursing home refused to transfer Mrs. Emmons to a hospital although she was begging the personnel not to let her die. In the lawsuit, the nursing home contended it was not responsible and that Mrs. Emmons died from peritonitis of the abdominal cavity.
The Emmons family was represented by Jim Yance of Mobile, Gil Gilmore of Grove Hill, Utsey and Utsey of Butler.
Willow Trace Nursing Home was represented by Ed Bowron of Mobile and John W. Thompson, II of Butler.
