Alabama Dept. of Revenue v. Frederick, [Ms. 2130711, Oct. 24, 2014] __ So. 3d __ (Ala. Civ. App. 2014). A notice of appeal to an Alabama appellate court cannot be filed electronically. In dismissing the appeal that the Department of Revenue attempted to file electronically on the last day for an appeal, the Court of Civil Appeals discusses the applicable authorities establishing that a notice of appeal cannot be electronically filed, including "a September 6, 2012, document entitled 'Administrative Policies and Procedures for Electronic Filing in the Civil Division of the Alabama Unified Judicial System' ('the Electronic Filing Policy Manual') [which] governs electronic filing," and the information contained in the electronic filing system that warns users not to electronically file notices of appeal.
