When Is It Legal to Use a Phone While Driving?

|

Most states have some sort of regulation prohibiting distracted driving. Some states ban all use of a smartphone while driving unless the device is mounted on a hands-free stand. Other states only ban certain activities on a smartphone. Get informed on Alabama’s distracted driving laws and when it is legal and illegal to use a phone while driving.

Alabama’s Distracted Driving Laws

Distracted driving laws vary from state to state. In Alabama, motorists may not read, compose, or send text messages while driving. Additionally, certain motorists are prohibited from making calls while driving. Specifically, Alabama’s distracted driving laws prohibit the following:

  • All forms of “text-based communication,” including text messages, emails, and social media messages for all motorists.

Forms of device use not listed above are permitted in the state of Alabama. Additionally, there are certain situations where the rules above may be legally violated, including:

  • Using a device to contact emergency services.
  • Using a device while parked on the shoulder of a highway, road, or street.
  • Using a device as a GPS or navigation system to receive preprogrammed driving directions.

The penalties for a distracted driving violation may include hundreds of dollars in fines or a reckless driving charge. If distracted driving results in the death of another, the negligent motorist may face vehicular homicide charges.
