LaFlore v. Huggins, [Ms. SC-2023-0254, Oct. 20, 2023] __ So. 3d ___ (Ala. 2023). The Court (Mitchell, J.; Parker, C.J., and Shaw, Bryan, and Mendheim, JJ., concur) affirms the Clarke Circuit Court’s bench verdict rejecting claims by LaFlore asserting she had acquired legal title to part of her neighbors’ property by adverse possession.
LaFlore sought to have the trial court establish a true boundary line between her property and her neighbors’ property and claimed that she had acquired a portion of the neighbors’ property by adverse possession. Ms. *2. After a bench trial, the trial court rejected LaFlore’s claim and declared the true boundary to be the original property line that existed when her family originally purchased the property. Ibid.
On ore tenus review, the Court affirms, holding the record does not demonstrate that there was any measurable span of time in which LaFlore’s possession of the disputed property was exclusive. Ms. *11.
