Bivins, Magistrate Judge) (Report and Recommendation) grants plaintiffs’ motion to remand in this diversity-based removal upon concluding the removing defendants failed to meet their burden of proving the jurisdictional amount-in-controversy given the generalized allegations in the complaint concerning physical injuries, medical expenses, lost income and other claimed damages. Further, plaintiffs’ responses to the removing defendants’ requests for admissions which refused to stipulate that the claims did not exceed $75,000.00 in value did not satisfy the burden of proof on the jurisdictional issue.
