Ex parte Springhill Hospitals, Inc. d/b/a Springhill Memorial Hospital [Ms. SC-2025- 0121, Apr. 8, 2025], ___ So.3d ___ (table). Alabama Supreme Court denies Petition for Writ of Mandamus filed by Springhill Hospital where it claimed Mobile Circuit Judge Benjamin H. Brooks, III erred in denying its Motion for Summary Judgment claiming immunity from liability for medical negligence pursuant to Governor Ivey’s May 8, 2020 Eighth Supplemental Covid Emergency Proclamations Liability Protections for Healthcare Providers and/or the February 12, 2021 Alabama Coronavirus Immunity Act now codified at §§ 6-5-790, et seq. Specifically, Springhill Hospital contended Judge Brooks erred in concluding the Proclamation and Act require a showing of a causal connection between the act or omission that injured the Plaintiff and any lack of resources at a hospital caused by the pandemic. Springhill Hospital also argued that Ex parte Triad of Alabama, LLC, [No. SC-2023-0395], 2024 WL 295247, ___ So.3d ___ (Jan. 26, 2024) conferred immunity upon healthcare providers for any claim that arises from or is related to Coronavirus.

Each of Springhill Hospital’s contentions were rejected.
