Settlement for Industrial Negligence Case After Catastrophic Electrical Accident
CONFIDENTIAL
On the morning of October 13, 2022, a skilled tradesman was performing routine electrical maintenance at an industrial plant when a catastrophic defect in the facility’s electrical system resulted in a devastating incident. Due to a series of critical safety lapses and mismanagement by plant personnel, a sudden surge of 35,000 volts of electricity back-fed into the system, electrocuting the worker as he performed his duties. Trapped in the energized equipment, he suffered severe burns, excruciating pain, and life-threatening injuries before a colleague was able to pull him free.
Cunningham Bounds joined a lawsuit on his behalf, along with counsel Eaton Barnard, asserting claims of negligence against the plant, it’s operators and contractors responsible for electrical system oversight. Evidence revealed that the plant lacked proper inspection procedures and allowed unqualified personnel to make critical safety decisions. The lawsuit alleged that these failures directly led to the life-altering injuries suffered by our client.
After extensive litigation, a settlement was reached, securing $6 million in compensation.
The injured worker suffered third-degree burns to 1-2% of his total body surface and required multiple skin graft surgeries. His dominant hand sustained permanent damage, and he suffered PTSD significantly affecting his ability to return to his former trade.
While no amount of money can undo the suffering he has endured, this settlement provides much-needed support for his future. Cunningham Bounds remains dedicated to advocating for workers who are harmed by corporate negligence and fighting for accountability in dangerous workplaces.
