Settlement Negotiated for Property Owners Against Weyerhauser for Industrial Air Pollution
Atwood V. Weyerhauser, USA, Inc., Et Al. | Circuit Court of Wilcox County, Alabama | CIVIL ACTION NO. CV-2009-900024.80
In 2014, Cunningham Bounds settled a case involving widespread and devastating pollution affecting the Yellow Bluff community in Wilcox County, Alabama. The Pine Hill mill, initially run by Defendant Weyerhaeuser, and later run by Defendant International Paper, persistently threw millions and millions of pounds of hydrogen sulfide into the air as a result of an unregulated waste water treatment system.
The Yellow Bluff community, directly across the street from the mill, suffered significant sulfur gas based corrosion, which resulted in the degradation of air conditioners, appliances, refrigerators, and other electrical items, while likewise affecting home-wiring, circuit breakers, switches, fire alarms, electrical outlets and receptacles, as well as the health and well-being of children and adults alike.
Cunningham Bounds represented 177 property owners who owned approximately 955 acres of property inhabited by approximately 450 - 500 men, women, and children. The amount of the settlement is confidential.
